Refund policy

1. Legal Basis

This policy is drafted in accordance with Law No. 105 of 13.03.2003 on Consumer Protection, including the Annex – List of non-food products of proper quality that cannot be returned or exchanged for a similar product.

Pursuant to item 1 of the Annex, jewelry items (articles made of precious metals, with precious stones, precious metals mounted with semi-precious and synthetic stones, as well as cut precious stones) may not be returned or exchanged if they are of proper quality.

2. Products That Cannot Be Returned or Exchanged

The return or exchange of the following products is not accepted if they are compliant and free of manufacturing defects:

  • jewelry made of precious metals;
  • jewelry set with natural pearls, semi-precious stones, synthetic stones or other decorative elements;
  • jewelry sets;
  • products without manufacturing defects.

If the product complies with the description, technical specifications and presents no non-conformities, it may not be returned or exchanged due to personal preferences (size, color, model, design, etc.).

3. Exceptions – Non-Conforming Products

In accordance with applicable legal provisions, the consumer has the right to claim:

  • manufacturing defects;
  • non-conformity of the product with its description;
  • delivery of a product different from the one ordered;
  • damage occurring during transportation.

Damage resulting from the following does not constitute non-conformity within the meaning of the law and does not entail the seller’s liability:

  • improper use;
  • application of mechanical force;
  • dropping or impact;
  • contact with chemical substances;
  • scratches or normal wear;
  • improper storage;
  • interventions performed by unauthorized persons.

In such cases, the company may offer repair services at an additional cost.

3.1 Notification Deadlines

For visible manufacturing defects, notification must be made within 14 calendar days from the date of receipt.

The complaint must be submitted in writing and accompanied by:

  • proof of purchase (receipt/invoice);
  • relevant photographs of the product and packaging (where applicable).

Claimed products will undergo internal technical examination to determine the cause of the damage.

Depending on the findings, the seller shall, as applicable:

  • remedy the defect;
  • replace the product;
  • refund the product value, in accordance with the law.

4. Personalized Products

Products made to special order or personalized at the client’s request (length adjustments, technical modifications, individual design, etc.) cannot be returned if they comply with the placed order.

5. Final Provisions

This policy applies to all products sold by Pearl Code and forms an integral part of the general terms and conditions of sale.
